1. About NearMeQuotes

NearMeQuotes ("NearMeQuotes," "we," "us," or "our") operates nearmequotes.com and related subdomains as a lead generation service. We are not a contractor, home improvement company, or licensed tradesperson. We connect homeowners and property owners ("Users") with independent, third-party home improvement contractors ("Contractors") by collecting User information and distributing it to Contractors in our network.

We do not perform any home improvement work, provide any warranties on Contractor work, or guarantee the quality, licensing, or reliability of any Contractor.

2. Eligibility

To use our services, you must:

Be at least 18 years of age
Be a resident of the United States
Have legal authority to authorize home improvement work at the property address provided
Provide accurate, complete, and truthful information in any form submission

By using our services, you represent and warrant that you meet all eligibility requirements above.

3. Description of Services

When you submit a quote request through our website or any of our landing pages, NearMeQuotes will:

Collect the personal and project information you provide
Match your request with one or more Contractors in our network based on your location and project type
Transmit your contact information and project details to those matched Contractors
Facilitate communication between you and Contractors for the purpose of obtaining quotes

Our service is provided free of charge to homeowners. Contractors pay us for the leads we deliver.

4. TCPA Consent — Express Written Consent to Be Contacted

Important — TCPA Disclosure. By submitting any form on this website, you provide your express written consent, as that term is defined under the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227), to receive telephone calls (including calls using an automatic telephone dialing system or an artificial or prerecorded voice), SMS text messages, and email communications from NearMeQuotes and from Contractors in our network at the telephone number and email address you have provided, even if your number is on a state or federal Do Not Call registry. This consent is not a condition of any purchase. Message and data rates may apply for SMS. You may revoke this consent at any time by replying STOP to any text message or by emailing info@nearmequotes.com.

5. No Guarantee of Contractor Quality or Availability

NearMeQuotes makes reasonable efforts to work with qualified Contractors but does not:

Verify, guarantee, or warrant the licensing, insurance, bonding, workmanship, or reliability of any Contractor
Guarantee that any Contractor will contact you, provide a quote, or complete your project
Guarantee the accuracy of any quote provided by a Contractor
Guarantee that a Contractor is available in your specific area or for your project type

You are solely responsible for independently verifying a Contractor's license, insurance, and qualifications before entering into any agreement or allowing work to begin on your property.

6. No Contractor–Client Relationship with NearMeQuotes

NearMeQuotes is not a party to any agreement between you and a Contractor. Any contract, warranty, guarantee, or dispute is solely between you and the Contractor. NearMeQuotes is not liable for any acts, omissions, injuries, property damage, or losses arising from work performed (or not performed) by a Contractor.

7. Accuracy of Information

You agree to provide accurate, complete, and truthful information when submitting a quote request. Submitting false, misleading, or fraudulent information — including fake contact details, requests for non-existent projects, or use of another person's contact information without their consent — is strictly prohibited and may constitute fraud under applicable federal and state laws.

8. Prohibited Uses

You agree not to use our services to:

Submit fake, spam, or test lead requests
Harvest contractor contact information for unsolicited marketing
Scrape, copy, or reproduce any content from our website without permission
Reverse-engineer, interfere with, or disrupt our systems or infrastructure
Impersonate any person or entity
Violate any applicable federal, state, or local law or regulation

9. Disclaimer of Warranties

    OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
  

10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEARMEQUOTES AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR ANY CONTRACTOR'S WORK, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 11. Indemnification

You agree to indemnify, defend, and hold harmless NearMeQuotes and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any dispute between you and a Contractor.

12. Dispute Resolution and Binding Arbitration

Please read this section carefully — it affects your legal rights.

Informal Resolution First. Before initiating any formal legal proceeding, you agree to contact us at info@nearmequotes.com and attempt to resolve any dispute informally for at least 30 days.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You and NearMeQuotes each waive the right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in your individual capacity.

Exceptions. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims that qualify for small claims court may be brought there instead of arbitration.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States and the state in which NearMeQuotes is principally operated, without regard to conflict of law principles. For any matters not subject to arbitration, you consent to personal jurisdiction in the applicable federal or state courts.

14. Intellectual Property

All content on this website, including text, design, graphics, logos, and code, is the property of NearMeQuotes or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

15. Third-Party Links and Services
